Terms of Use

These Terms of Use govern your use of the Bean Passport mobile application and related services provided by Arvo Labs.

These Terms of Use ("Terms") govern your use of the Bean Passport mobile application ("App") and related services made available by Arvo Labs ("we", "us", "our"), based in Melbourne, Victoria, Australia.

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. About the App

Bean Passport is a personal coffee journal. It lets you log cups, view stats, and build a "passport" map of places you have had coffee. The App is designed to store your coffee logs locally on your device. We do not operate a user account system for the App, and we do not host your coffee journal on our servers.

These Terms apply to the App only. Use of our website at arvolabs.com.au is governed separately.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the involvement and consent of a parent or legal guardian.

By using the App, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

3. Licence to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use.

You must not:

4. Your content and data

4.1 What you create. The App lets you create and store information such as coffee logs, notes, ratings, photos, optional location pins, café names, and passport profile details ("Your Content").

4.2 Local storage. Your Content is stored on your device unless you choose to share it outside the App (for example, via your device's share sheet or by backing up your device through Apple, Google, or another provider). We do not receive or store Your Content on our servers as part of normal App operation.

4.3 Your responsibility. You are responsible for Your Content and for maintaining backups of your device. If you delete the App, reset your device, or lose your device without a backup, Your Content may be permanently lost. We are not responsible for any loss of Your Content.

4.4 Licence to us. Because we do not collect Your Content on our servers, we do not require a broad licence over Your Content to operate the App. If you contact us for support and voluntarily provide information, you grant us a limited licence to use that information only to respond to your request.

5. Optional features and device permissions

Some features require device permissions, which you may grant or deny:

You can change permissions in your device settings. Some features may not work without the relevant permission.

Café search and Discover. When you search for a café or use the Discover tab, your approximate location and search query may be sent to Google Places API to return nearby cafés and ratings. Map tiles are loaded from OpenStreetMap contributors.

Get Directions. When you request directions to a café from Discover, the café name and location are passed to your chosen maps app (Apple Maps, Google Maps, or Waze). Those apps are governed by their own terms and privacy policies.

6. Free use, trial, and Patron plans

6.1 Free use. Bean Passport may be used without payment. After an initial free period, core App functionality remains available without purchase.

6.2 Optional Patron support. We offer optional paid plans ("Patron" plans) that support development of the App:

Patron status is primarily a way to support the App. Features, badges, or prompts associated with Patron status may change over time, but we will not remove core free functionality solely because a Patron plan ends.

6.3 Free trial. If offered, your first 14 days after first launch may be treated as a free trial period with access to Patron features. Trial terms may vary by platform and region.

7. Purchases, billing, and refunds

7.1 App Store and Google Play. All purchases are processed by Apple (App Store) or Google (Google Play), not directly by us. By making a purchase, you also agree to the applicable store's terms and payment policies.

7.2 Monthly Patron subscription. If you purchase Monthly Patron:

The price displayed in the App at the time of purchase applies. Prices may vary by region and are set by the applicable store.

7.3 Lifetime Patron. Lifetime Patron is a one-time purchase tied to the Apple ID or Google account used to buy it. "Lifetime" means for as long as we continue to make the App available and the applicable store supports restoration of non-consumable purchases, not for your entire life or ours.

7.4 Restore purchases. You may use the "Restore purchases" option in the App to restore Patron status on a device linked to the same store account used for the original purchase.

7.5 Refunds. Refund requests must be made through Apple or Google, subject to their policies. We cannot process store billing refunds directly. Nothing in these Terms limits any non-excludable rights you may have under the Australian Consumer Law.

8. Acceptable use

You agree not to use the App:

We may suspend or terminate access to the App if we reasonably believe you have breached these Terms.

9. Third-party services

The App interacts with the following third-party services:

Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

10. Intellectual property

The App, including its design, branding, code, and original content (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws.

"Bean Passport", "Arvo Labs", and related logos and marks are our trademarks or those of our affiliates. You may not use them without our prior written consent.

11. Disclaimers

The App is provided for personal informational and journaling purposes only. It is not medical, nutritional, or financial advice. Caffeine estimates, spending totals, and stats are approximate and depend on the information you enter.

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free from loss of data.

12. Limitation of liability

To the maximum extent permitted by law:

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or other applicable non-excludable law.

13. Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from Your Content or your misuse of the App, except to the extent caused by our negligence or breach of these Terms.

14. Changes to the App and Terms

We may update the App or these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as updating the effective date above or showing a notice in the App.

Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App and uninstall it.

15. Termination

You may stop using the App at any time by uninstalling it.

We may discontinue the App or any part of it, or terminate or suspend your licence, if required by law, by an app store, or if you breach these Terms.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and governing law.

16. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

If you are a consumer under the Australian Consumer Law, you may also have rights that apply regardless of this clause.
